Legal
Terms and Conditions – BlitzFin
BlitzFin terms and conditions – the terms governing use of the construction cost controlling platform.
Please note: this English text is a
convenience translation. The German version (AGB) is the legally
binding one.
1. General and conclusion of contract
These terms and conditions apply to contracts for the use of the software-as-a-service
products we provide under the “BlitzFin” brand:
- BlitzFin Cost Control (project room, DIN 276 controlling, reports)
- BlitzFin Construction Cost Calculator
Differing terms and conditions of the customer do not become part of the contract unless
their applicability is expressly agreed.
2. Formation of contract
NOTE: paid plans are always clearly identified as such during the
ordering process. The demo and setup phase is free of charge.
- The presentation of plans on this website does not constitute a legally binding offer.
- By clicking the relevant order button, customers submit an offer to enter into a contract.
- The offer is binding for one working day.
3. Right of withdrawal
Consumers have a right of withdrawal (Widerrufsrecht) in accordance with statutory
provisions. In the case of services, the right of withdrawal expires where the trader has
fully performed the service and only began performing it after the consumer gave their
express consent to do so.
4. Availability of the services
We aim for service availability of 99.5%. Maintenance work, force majeure and other
unforeseeable events may affect availability.
5. Prices and payment terms
- All prices are exclusive of statutory VAT.
- A new project room can be tested free of charge for up to 30 days. Thereafter the
project price must be booked in order to continue using it; otherwise the project room
is switched to read access. Unused trial days are not refunded.
- The project price is paid in 20 monthly instalments: two instalments on booking, the
remaining 18 from the start of construction. Start of construction is the point at
which an invoice in cost groups 300 to 600 (DIN 276) is first booked in the project
room, but no later than 36 months after booking; the customer may also report the
start of construction themselves. We inform the customer before the 36-month deadline
is reached; on request the deadline can be extended.
- The amount of the monthly instalment is determined by the project's cost forecast
across cost groups 200 to 700: up to €2M under the Small plan, above that under the
Standard plan. The cost forecast is the sum across all cost line items of the project;
for each cost line item, the highest of the following values applies: the budget
defined, the total contract value, the amount invoiced and the forecast recorded. The
cost forecast is determined monthly on the debit date; a change of plan applies
exclusively to future instalments. Projects with a cost forecast above €20M require a
separate agreement.
- Where a booking is made under the Small plan and the project is later classified under
the Standard plan (or vice versa), the instalments paid on booking are credited
against the instalments of the applicable plan.
- From the start of construction, the customer may pay the remaining instalments in one
go; in that case the number of remaining instalments is reduced by two.
- Organisation plans are billed monthly or annually in advance. Project rooms can be
created and used before the start of construction at no additional cost. Projects
count towards the total volume (up to €50M) with their cost forecast (cost groups
200–700) from the start of construction until they are marked as completed. The
organisation plan covers up to 20 concurrently running project rooms and a total
forecast across all project rooms of up to €100M; if these are exceeded, we will get
in touch to agree an adjusted plan.
- If a follow-on or additional plan (such as your own brand) is booked while a paid or
granted period is still running, the new billing period only begins when that period
ends; time already paid for is not lost. The date of the first debit is shown during
the ordering process.
- In the event of late payment, we reserve the right to restrict access to the services.
6. Contract term and termination
- A project contract ends on payment of the 20th instalment or on closure of the project
by the customer. On closure, instalments not yet due cease to apply; instalments
already paid are not refunded. The right to extraordinary termination for good cause
remains unaffected.
- Organisation plans can be terminated at the end of the respective billing period.
- After a project is completed, read access remains available free of charge for
5 years (warranty phase).
- Once those five years have elapsed, the project data is deleted after prior notice by
email (at least 3 months), unless the customer has exported it beforehand or books the
project again.
- Should we discontinue the service, we will give at least 6 months' notice and ensure
that all project data can be exported until then.
7. Customer obligations
The customer undertakes:
- to use the services properly,
- to keep their access credentials confidential,
- to carry out their own regular data backups using the export function provided,
- to comply with statutory provisions.
8. Support
- We support one contact person named by the customer, per organisation — under the
project plan, per project room — by email on working days.
- Supporting further users, in particular clients, planners and contractors whom the
customer invites into a project room, is the customer's responsibility.
- There is no entitlement to telephone support or to response times unless separately
agreed.
9. Data protection and data security
- We undertake to comply with data protection legislation.
- Data processing takes place in accordance with our privacy policy.
- The customer remains the owner of their data and can extract it at any time using the
export function.
- Insofar as we process personal data on behalf of the customer in the course of the
services, the data processing agreement (DPA) in the version
valid at the time the contract is concluded forms part of this contract. The DPA
governs the subprocessors we use and the procedure
for changing them.
10. Warranty
- We warrant that the services will be provided in accordance with the contract.
- In the event of defects, we will first attempt remedial action.
- Further warranty claims are governed by statute.
11. Liability
- We are liable for damages only in cases of intent and gross negligence.
- Liability for slight negligence is limited to the breach of material contractual
obligations.
- Liability is limited in amount to the foreseeable damage.
12. Transfer of rights and obligations
The customer may transfer their rights and obligations under this contract to third
parties only with our written consent.
13. Final provisions
- German law applies, excluding the UN Convention on Contracts for the International
Sale of Goods.
- The place of jurisdiction is Hannover.
- Should individual provisions be invalid, this does not affect the validity of the
remainder of the contract.
14. Special conditions for the Construction Cost Calculator
- Basic use of the Construction Cost Calculator is free of charge. Access is provided
by email link after the onboarding form has been completed; calculations created
remain stored in the user account.
- The Construction Cost Calculator provides non-binding cost estimates
based on reference projects and on regional and time-based index values. The results
do not replace professional planning, cost calculation or advice; we accept no
liability for the estimate corresponding to actual construction costs.
- The Construction Cost Calculator may be offered in collaboration with partners (for
example architecture or construction firms) and may carry their branding. In all
cases, the contracting party for its use remains exclusively
blue media labs GmbH.
- Paid additional features are clearly identified as such before booking and are billed
at the prices displayed there.
